Fisher & Thomsen Messaging provides technology and automation tools. We are not the service provider performing the customer’s underlying home, commercial, repair, maintenance, or other requested service.

2. AI-Generated Communications

AI-generated responses may occasionally contain errors, inaccuracies, or incomplete information. Businesses using our Services are responsible for reviewing their configurations, services, pricing, policies, and other information provided to customers through the Services.

Our Services should not be relied upon as a substitute for professional judgment when a situation requires a qualified human professional.

3. Customer Communications and SMS

Our Services may send and receive SMS messages on behalf of businesses using our platform.

Businesses using our Services are responsible for obtaining all required customer consent before sending messages and for complying with applicable messaging, telecommunications, privacy, and consumer-protection laws and regulations.

Message frequency may vary depending on the customer’s interaction with the business.

Customers may opt out of SMS communications by replying STOP and may request assistance by replying HELP where supported.

Message and data rates may apply depending on the customer’s mobile carrier and plan.

Fisher & Thomsen Messaging does not sell customer phone numbers or SMS consent information.

4. Business Responsibilities

Businesses using our Services are responsible for:

Providing accurate business information;

Maintaining accurate service, pricing, availability, and scheduling information;

Obtaining appropriate customer consent for communications;

Using the Services in compliance with applicable laws and regulations;

Maintaining appropriate access to their accounts;

Reviewing AI-generated communications and configurations;

Ensuring that their use of the Services does not violate the rights of customers or third parties.

You may not use the Services to send unlawful, fraudulent, deceptive, abusive, threatening, or otherwise prohibited communications.

5. Accounts and Security

Businesses are responsible for maintaining accurate calendars and appointment availability.

8. Fees and Payments

If you purchase paid Services, you agree to pay the applicable fees presented at the time of purchase or in your applicable service agreement.

Unless otherwise stated, subscription fees may automatically renew according to the billing period selected.

Fees are generally non-refundable except where required by law or where otherwise stated in your applicable agreement.

We reserve the right to change our pricing with reasonable notice.

9. Intellectual Property

The Services, including our software, website, branding, designs, logos, technology, and other materials provided by Fisher & Thomsen Messaging, are owned by or licensed to Fisher & Thomsen Messaging and are protected by applicable intellectual-property laws.

Businesses retain ownership of their own business data and customer information, subject to the rights necessary for us to provide the Services.
